Pokémon Center Singapore Entry Lottery Terms and Conditions

Pokemon Singapore Pte. Ltd. (hereinafter referred to as the "Company") wishes to provide a safe and secure store environment for customers and to promote fair access to the Company's products.  

These Terms and Conditions (hereinafter referred to as the "Terms") shall apply to customers who use the Pokémon Center Singapore Entry Lottery Application Site (hereinafter referred to as the "Site").

By commencing the use of the Site, the User (as defined below) shall be deemed to have agreed to the Terms.

Chapter 1 General Provisions

Article 1. (Definitions)

The terms used in these Terms shall have the following meanings:

1. "User" means a customer who uses the Site.

2. "Service" means the service in which the Company conducts a lottery upon receiving applications from Users and grants the successful applicants with the Right of Entry, and to receive services incidental thereto.

3. "Store" means Pokémon Center Singapore operated by the Company.

4. "Application Procedure" means the procedure to apply for the lottery to obtain the Right of Entry.

5. "Right of Entry" means the right to enter the Store, for which applications can be made through the Site.

Article 2. (Minors)

1. Minors may perform the Application Procedure only with the consent of a person with parental authority or his/her other legal representative. If a minor performs the Application Procedure, it shall be deemed that the consent of a person with parental authority or his/her other legal representative has been obtained.

2. Minors may use the Service only with the consent of a person with parental authority or his/her other legal representative. If a minor uses the Service, it shall be deemed that the consent of a person with parental authority or his/her other legal representative has been obtained.

Article 3. (Scope of the Terms, etc.)

All usage guidelines, rules, and other regulations relating to the Site stipulated by the Company shall constitute a part of the Terms, regardless of their title.

In addition, notices and other terms separately presented during the Application Procedure and the announcement of the results of the lottery shall all constitute a part of the Terms.

Article 4. (Protection of Personal Information)

The Company may receive personal information from Users in connection with the Service and access logs of users of the Site and other websites operated by the Company acquired through cookies, etc. The Company may use, free of charge, such personal information for purposes such as the provision of the Service including the announcement of the results of the lottery and the improvement of User experience, on the Site and other websites operated by the Company and in SMS sent by the Company regarding the Service.

Article 5. (Intellectual Property Rights)

Users shall not acquire any intellectual property rights, claims, or any other rights regarding any content provided through the Site and the Service (including, without limitation, User data concerning the use of the Site, aggregate information, and other information).

Furthermore, Users shall not use the content provided through the Site and the Service other than on the Site and in connection with the Service.

Article 6. (Prohibited Acts)

The Company prohibits the following acts:

1. Providing false information during the Application Procedure.

2. Performing the Application Procedure or using the Site under another person's name or a fictitious name.  

3. Reproducing data from the Site or providing such copies to others.

4. Infringing the intellectual property rights or other rights of the Company or other third parties.

5. Reselling, exchanging, transferring, sharing with a third party, or sublicensing the Right of Entry (including the URL and screenshots of the successful application screen; hereinafter the same shall apply in this Article), and receiving or giving money or valuables in connection therewith; or using the Site or performing the Application Procedure for the benefit of a third party.

6. Using a Right of Entry obtained through resale, exchange, or transfer as set forth in the preceding items.

7. Reproducing the Right of Entry and using such copies.

8. An individual submitting multiple identical applications exceeding any limit set by the Company.

9. Using unauthorized third-party software or other technical methods (such as bots, mods, hacking, and scripts) to alter the systems, applications, etc., of the Site.

10. Gaining unauthorized access into the servers operating the Site.

11. Acts that may cause malfunctions, bugs, or other defects in the servers operating the Site.

12. Developing programs, etc., for the purpose of the unauthorized use of the Site, regardless of whether they are called unauthorized programs, tools, apps, or any other name; or providing such programs, etc., to others or allowing others to use them.

13. Alteration (including falsification of data), modification, adaptation, creation of derivative works, decompilation, disassembly, or reverse engineering of data on the Site, or acts similar thereto.

14. Causing others to perform the acts described above or encouraging others to perform them.

15. Acts that assist or facilitate others in performing the acts described above.

16. Prohibited acts notified by the Company to Users or published on the Site or the official website of the Company.

17. Acts that violate or are likely to violate laws, regulations, or public order and morals.

18. In addition to the above, any and all acts that interfere with the operation of the Site and the Service.

19. Any other acts that the Company deems inappropriate.

Article 7. (Suspension, Change, Termination, etc. of the Site or the Service)

1. The Company may, at its own discretion and without notice, restrict, terminate, or suspend some or all functions of the Site for Users.

2. If it is found that a User has violated the Terms (including but not limited to Article 6, Article 10, and Article 13) or laws and regulations applicable to the User, the Company may, at its own discretion and without notice, suspend the provision of the Service to such User, suspend such User's membership registration, revoke his/her membership status, delete all related information, and refuse any and all future transactions with the Company.

3. The Company may change, postpone, or cancel the Service and invalidate Rights of Entry due to unavoidable circumstances such as natural disasters, the spread of epidemics, unforeseen accidents or other circumstances beyond its reasonable control. In such cases, the Company shall not grant alternative Rights of Entry and shall not bear any liability whatsoever.

4. The Company may, acting reasonably, close the Store at its sole discretion without notice and may invalidate Rights of Entry. In such cases, the Company shall not grant alternative Rights of Entry and shall not bear any liability whatsoever. 

5. Even in the circumstances set forth in the preceding paragraphs, the Company shall not bear any liability to Users, except where required by applicable laws and regulations.

Article 8. (Disclaimer)

1. The Company, having acted reasonably, shall not bear any liability for any damages arising from the User's inability to use the Service.

2. The Company, having acted reasonably, shall not bear any liability for any damages arising from the User's use of the Service.

3. The Company makes no warranty regarding the validity, accuracy, suitability, functionality, certainty, currency, completeness, etc., of the content, etc., of the Service.

4. The Company makes no warranty that the Service does not infringe the rights of third parties or is free from defects.

5. Links to websites or resources operated by third parties may be provided as part of the Service; however, the Company shall not bear any liability for the content, use, or results thereof of such websites, etc. Furthermore, the Company, having acted reasonably, shall not bear any liability for any damages incurred by the User through the use of such websites, etc.

6. The Company accepts the use of the Site or applications for the Service based on the information provided during the Application Procedure. To the extent permitted by law, the Company shall not bear any liability for damages incurred by the User due to errors in such information. 

7. If a User causes damages, etc. to the Company in connection with the use of the Service, such User shall compensate the Company for such damages.

8. If a User causes damages, etc. to other Users or third parties in connection with the use of the Service, such User shall resolve this at their own responsibility and expense and shall not cause any damages, losses, disadvantages, nuisance, etc. to the Company.

9. Where the Company has an obligation to notify a User, it shall be deemed to have fulfilled such obligation by sending a notification to the registered telephone number, and the Company shall not bear liability for any damages incurred by the User in the event that the notification does not reach the User due to the User's failure to report a change in telephone number, incorrect entry of the telephone number, or any other reason.

10. The Company shall not bear liability for accidents caused by the User's carelessness or troubles between Users, except where an obligation to compensate arises under laws and regulations.

Article 9. (Changes to the Site and the Terms)

1. The Company may change the content of the Site at any time without notice to Users.

2. The Company may change all or part of the Terms without obtaining the User's prior consent by making the changes known through publication on the Site or by other methods deemed appropriate by the Company.

3. Changes to the Terms pursuant to the preceding paragraph shall apply from the effective date stipulated at the time of notification or publication. Users shall be deemed to have accepted such changes as long as they continue to use the Site.

Article 10. (Governing Law and Jurisdiction)

1. The interpretation and application of the Terms shall be governed by the laws of Japan.

2. All disputes, controversies or differences between the Company and the User arising out of or in connection with these Terms shall be finally settled by arbitration in accordance with the Commercial Arbitration Rules of The Japan Commercial Arbitration Association. The place of arbitration shall be Tokyo, Japan, and the language of the arbitration proceedings shall be Japanese. 

Chapter 2 Application

Article 11. (Application Procedure, etc.)

1. The Application Procedure is limited to individuals residing in Singapore and holding a Singapore telephone number.

2. Users may confirm the application details such as the application number via the screen of the Site displayed after completion of the application, SMS from the Company, etc.

3. The announcement of the results of the lottery will be made on a website designated by the Company. After the processing by the Company, at the timing when the announcement of the results of the lottery becomes possible, the Company will notify the User of the URL of the website at which the results of the lottery will be announced via SMS. Users shall access the said website and check the results of the lottery themselves.

Article 12. (Change and Cancellation of Application Details)

No changes to or cancellation of application details will be accepted after the Application Procedure.

Chapter 3 Store

Article 13. (Precautions and Prohibited Acts upon Entering the Store)

When a User enters the Store using the Service, the User must observe the Terms, as well as precautions displayed on the Site and at the Store, and requests from the Company and the Company's employees.

The Company prohibits the following acts by Users:

1. Acts of nuisance towards Store staff and other customers (including photography of Store staff without permission) and acts of violence.

2. Purchasing products for the purpose of resale.

3. Photography for commercial purposes.

4. Photography, recording and public transmission that cause trouble to other customers.

5. Entering the Store outside the designated time slot (including late entry after the designated time slot has passed) and re-entry after initial entry.

6. Waiting near the Store before the designated time slot.

7. Acts of not following the instructions of Store staff.

Article 14. (Refusal of Entry, Expulsion, etc.)

If a User violates the Terms (including but not limited to Article 6, Article 10, and Article 13), the Company may, at its own discretion and without notice, refuse the User's entry to the Store, require the User to leave the Store, invalidate the Right of Entry, refuse any and all future entry to the Company's premises, and refuse any and all future transactions with the Company. The Company may check the User's personal identification documents (driver's license, passport, etc.) when taking the measures described above.

Chapter 4 Right of Entry

Article 15. (Right of Entry)

1. The Right of Entry grants the right to enter the Store and does not guarantee the purchase of specific products (including the availability of stock) and/or the right to participate in specific events.  

2. The Company reserves the right to change the Right of Entry at its sole discretion without notice, and may change the content due to reasonable circumstances.

3. In order to use the Right of Entry, the User personally must come to the Store at the time designated by the said Right of Entry and present the said Right of Entry in the manner prescribed by the Company (presenting a live screen showing the designated date and time and undergoing a validation operation by Store staff). Presentation of screenshots, printed copies of the screen, or other static images is not permitted, and entry will be refused.

4. The Company may specify in advance the number of people allowed to enter the Store for each Right of Entry. Such specification will be made by way of separate notices at the time of the Application Procedure and/or upon announcement of the results of the lottery for the relevant Right of Entry.

5. Depending on crowd conditions, etc., customers who do not hold a Right of Entry may be permitted to enter the Store.

Article 16. (Disclaimer regarding Entry and Store Use)

1. If the User does not come to the Store at the time designated in the Right of Entry, it shall be deemed a cancellation of the Right of Entry. The Company will not provide any compensation for this, including any re-granting of the Right of Entry.

2. The Company will not provide any compensation in the event that the User is unable to purchase the desired products due to such products being out of stock, discontinued, etc.
