    Privacy Policy

    The Pokémon Company and its affiliates listed below* (collectively, hereinafter “Pokémon Group”), recognize theimportance of Personal Information (as defined in the “Definition of Personal Information”) and are committed toprotecting Personal Information. This Privacy Policy sets forth the rules that Pokémon Group companies should complywith for the appropriate management and protection of your Personal Information and provides you with informationabout the Pokémon Group’s handling of Personal Information.

    This Privacy Policy constitutes an agreement between you and Pokémon Group. In order to use the Pokémon Group’sproducts and services, you need to fully understand and agree to this Privacy Policy. By using any of the PokémonGroup’s products or services, you will be deemed to have agreed to the terms and conditions of this Privacy Policy.

    If you are under age in the country or region that you reside in, you must confirm that your guardian or legalrepresentative has read this Privacy Policy and agreed to your use of Pokémon Group’s products and services underthe terms and conditions of this Privacy Policy. In cases where direct consent of your guardian or legalrepresentative is required, you must obtain such consent on your own responsibility.

    If you do not agree to this Privacy Policy, or if your guardian or legal representative does not agree to thisPrivacy Policy, you cannot use Pokémon Group’s products or services.

    Scope of this Privacy Policy

    This Privacy Policy applies to the handling of Personal Information by the Pokémon Group companies. In the eventwhere each Pokémon Group company has a privacy policy that applies only to specific countries or regions, orspecific products or services (hereinafter “Specific Privacy Policy”), and there is any discrepancy between thisPrivacy Policy and the Specific Privacy Policy, the Specific Privacy Policy shall prevail.

    If this Privacy Policy contains any provision for customers residing in a specific countries or regions, suchprovision shall apply.

    Definition of Personal Information

    The definition of “Personal Information” covered by this Privacy Policy shall be in accordance with the provisionsof the Act on the Protection of Personal Information of Japan (Act No. 57 of 2003, hereinafter “Act” including anyamendments or revisions thereafter) and other privacy-related laws and regulations in applicable countries andregions (hereinafter “Laws”).

    The “Personal Information” is defined in the Act as information relating to a living individual (i) containing aname, date of birth, or other descriptions, etc. whereby a specific individual can be identified (including thosedirectly lead to identification of a specific individual and those which can be readily collated with otherinformation and thereby identify a specific individual) or (ii) defined as an “individual identification code” suchas fingerprint, voiceprint, etc.

    In cases where this Privacy Policy applies to the Personal Information of the customers residing in Japan, the“Personal Information” shall include “personal data” and “retained personal data” as defined in the Act.

    Policy on protecting Personal Information

    1. 1Pokémon Group will comply with the Laws.
    2. 2Pokémon Group will handle the Personal Information only to the extent necessary to achieve the purposes of use specified in this Privacy Policy.
    3. 3Pokémon Group will keep the Personal Information accurate and updated and appropriately discard such information without delay after achieving the purposes of use. Further, when it is required by Laws, Pokémon Group will set a retention period for Personal Information and discard without delay the Personal Information whose retention period has expired.
    4. 4Pokémon Group will strive to take any necessary and appropriate action for the security control of Personal Information including preventing any unauthorized access, leakage, falsification, loss and damage, etc.
    5. 5Pokémon Group will strive to continuously review and improve its measures for protecting Personal Information.

    Collection of Personal Information

    1. 1Pokémon Group may collect from you various Personal Information including the following items, in oral or written form or by way of photographing, recording, electromagnetic recording media, emails, input on the Internet or any other means.

      Name, address, gender, age, date of birth, telephone number, fax number, email address, name of school, occupation, place of work, driver’s license number, passport number, information on the Pokémon Group’s products/services used by the customer (including user name for games, communication-related information (such as IP address), social media account, history of game play, playing method, etc.), photo/movie taken or recorded, voice, type of the Pokémon Group’s products/services ordered or purchased and purchase information such as credit card information and date of purchase, a copy of certificate of residence and the information that allows identification of a certain individual thereby.
    2. 2Pokémon Group will not collect any Personal Information which is particularly sensitive, such as a customer’s race, religion, social status or medical history without the prior consent of the customer; provided that this may not be the case if otherwise required by Laws.

    Purposes of use of Personal Information

    Pokémon Group will use the collected Personal Information only to the extent necessary to achieve the followingpurposes and the purposes expressly specified in advance.

    Purposes of use

    1. 1To handle order reception, settlement processing, shipment, after-the-sale service, repairs, etc. of products and services
    2. 2To contact the customers who applied for present campaigns or entered contests
    3. 3To respond to inquiries or requests from the customers and confirm the customers’ identifications
    4. 4To manage members of the websites, the online stores and email newsletters, etc. operated by Pokémon Group
    5. 5To operate, record and announce events concerning Pokémon Group’s products and services (including Pokémon trading card game tournaments)
    6. 6For announcement, advertisement and promotional activities concerning Pokémon Group’s products and services (including distribution of email newsletters and announcements)
    7. 7For the design, research, development or improvement of products/services as well as market research and analysis.
    8. 8To engage in any businesses ancillary or related to the above items.

    Joint use of Personal Information

    Pokémon Group companies may jointly use customers’ Personal Information pursuant to Laws.

    Provision of Personal Information to third parties

    Pokémon Group will not disclose or provide Personal Information to any third party except for the following cases:

    2. 2Disclosure or submission is made to the extent required by Laws.
    3. 3Disclosure is made in a manner that does not allow identification of individual customer, such as by statistical data.
    4. 4Disclosure or provision is made to a contractor (including contractors outside Japan) to the extent necessary to achieve the purposes of use. In this case, Pokémon Group will perform all necessary and appropriate supervision over the contractor by taking measures such as entering into an agreement with the contractor on the handling of Personal Information.
    5. 5Such disclosure or provision is required for the protection of life, health or property of a customer or a third party and it is difficult to obtain prior consent.

    Overseas transfer

    Pokémon Group may transfer your Personal Information outside of the country or region where you reside to theextent necessary to achieve the purposes of use specified in this Privacy Policy. In this case, Pokémon Group willtake necessary and appropriate measures pursuant to Laws, such as entering into a service agreement on the handlingof Personal Information.

    Changes to this Privacy Policy

    Pokémon Group may revise this Privacy Policy at any time in order to respond to the requirements of newly applicableLaws or for other reasons. The revised Privacy Policy will be published on this webpage and shall take effect uponsuch publication. If you continue to use Pokémon Group’s products or services after the revision, you will be deemedto have agreed to such revised Privacy Policy.

    Procedures and inquiries relating to Personal Information

    You are entitled to certain rights under Laws concerning notification of purposes of use, disclosure, correction,additions, deletion, suspension of use, removal or request for suspension of provision to third parties, etc. of thePersonal Information obtained by Pokémon Group. When exercising your rights, you may be asked to go throughidentification procedures.

    Cookie

    Cookie is used in some parts of the websites operated by Pokémon Group for the purpose of better use of thewebsites. Cookie refers to small pieces of data sent to your web browser at the time accessing the website. Suchdata enables us to find out users’ access history to our website. No information that can identify a certaincustomer is contained in the information obtained by Cookie unless a customer enters such information that canidentify the customer, such as by membership registration or otherwise. Please note that in the case of disablingCookie, restrictions for use of the websites are likely to occur.

    Notice to Singapore Residents:

    You may, at any time, withdraw any consent given or deemed to have been in respect of the collection, use ordisclosure of your Personal Information. However, please note that if you withdraw your consent to the collection,use or disclosure of your Personal Information, Pokémon Group may not be able to provide you with its products andservices.

    Pokémon Group will only collect National Identifiers (e.g. NRIC numbers, passport numbers, work pass numbers) fromyou to the extent permitted by Laws.

    As to the Purposes of use of Personal Information, you will have the option of whether or not to give consent tosome of the purposes i.e. purposes that are beyond what is reasonable for the provision of goods and services e.g.receiving advertisement and promotional materials, participating in research and development, etc. Notwithstandingthe above, there may be certain situations where Pokémon Group will require your consent for such purposes e.g.Pokémon Group may provide offers, discounts or lucky draw opportunities to individuals that are conditional on thecollection, use or disclosure of their Personal Information for specified purposes.

    As to Provision of Personal Information to third parties, Pokémon Group will obtain your consent for the disclosureto third party contractors unless otherwise specified by Laws.

    Where Personal Information is transferred out of Singapore, Pokémon Group will take steps to ensure that theoverseas recipient is bound by legally enforceable obligations to provide the transferred Personal Information acomparable standard of protection under Laws.

    Data Protection Policy

    1. 1.Pokémon Singapore, Pte. Ltd.(“Pokémon SG”) is a wholly owned subsidiary of the Pokémon Company (Japan).
    2. 2.Pokémon SG may, in the course of providing goods and services to you, collect, use, store, disclose or otherwise process your personal data. The term “personal data” refers to data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which the organization has or is likely to have access. The terms used in this Policy shall bear the meanings assigned to them under the Personal Data Protection Act 2012 (“the PDPA”) to the extent that the context allows.
    3. 3.Pokémon SG is committed to ensuring that any collection, use, storage, disclosure or otherwise processing of your personal data is done in compliance with the PDPA and the laws of Singapore. This Policy sets out the general principles that Pokémon SG will adhere to when collecting, using, storing, disclosing or otherwise processing of your personal data.     Consent for Collection, Use, and Disclosure

    1. 4.Pokémon SG will generally collect your personal data only where (a) you have been informed of the purpose (see [5] below) of the collection, use, or disclosure and you have consented to the collection, use, or disclosure of your personal data; or (b) collection of your data is otherwise permitted under the PDPA, including situations where you may be deemed to have consented to the collection, use, storage, disclosure or otherwise of your personal data (e.g. where you have voluntarily provided your personal data for any particular purpose listed at [5] below). You may arrange for your consent to be given via a third party whom you have authorized to give such consent.

      4. D)Sending you marketing information, newsletters, and other such media informing about our goods and services, including notifications on events, competitions, contests, projects, or campaigns at our stores;
      5. E)To manage your participation/membership in community groups and communities (e.g. fan clubs), which may be organized or hosted by us on the Internet, via newsletters, and other medium, and to use any comments received from you as material for such community groups and communities;
      6. F)Complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

    4. 7.The purposes listed at [5] may continue to apply for a reasonable period after your relationship with us (e.g. for example pursuant to a contract) has ended (including, where applicable, a period to allow us to enforce our rights under any contract with you).

    Withdrawal of Consent

    1. 8.If you have given us consent to collect, use, or disclose your personal data, that consent shall remain valid until it is withdrawn by you. You may withdraw consent and request us to stop collecting, using and/or disclosing your personal data for any or all of the purposes listed above. This can be done by submitting your request for withdrawal in writing or via email to our Data Protection Officer (see [20] below for contact details).
    2. 9.If you submit a written request to withdraw your consent, we may require a reasonable time to process your request (depending on how complex your request might be). We will also notify you of how the withdrawal of consent will affect your legal rights and liabilities to us. Please note that in certain situations, the withdrawal of consent might result in us no longer being able to provide the same goods and services to you.
    3. 10.Please note that even where you may have withdrawn your consent, this does not affect our right to collect, use, and disclose personal data where such collection, use and disclosure without consent is permitted or required under the applicable laws.

    Access and correction of personal data

    1. 11.You may, by submitting a request in writing or via email to our Data Protection Officer, request to access the personal data which we hold about you or information about the ways in which we use or disclose your personal data. You may also, submit a request in writing, to correct or update any of the personal data which we hold about you. These submissions may be made to our Data Protection Officer (see [20] below for contact details).
    2. 12.Please note that we may change you a reasonable fee for such access.
    3. 13.We will respond to your request as soon as reasonably possible. If we are unable to do so within 30 days from your request, we will inform you in writing of the time when we will be able to respond. Please note that there are certain situations as provided for under the PDPA where we will not be able to, or are not required to, provide access or correction of personal data.

    Protection of Personal Data

    1. 14.We will adopt such reasonable administrative, physical and technical measures (including up-to-date antivirus protection and encryption) to secure all storage and transmission of personal data. The transmission/disclosure of personal data will only be done on a need-to-know basis.
    2. 15.Please note that while we shall take all reasonable steps to protect and secure your personal data, no protection methods are full-proof, and security cannot be guaranteed.

    Accuracy of Personal Data

    1. 16.We will generally rely on the Personal Data provided by you and will generally assume that such data is accurate. In order to ensure that your personal data is accurate, please check the data you are submitting carefully. Please also inform the Data Protection Officer (see [20] below) if there are any changes in your personal data.

    Retention of Personal Data

    1. 17.We will generally retain your personal data to the extent necessary to fulfill the purposes for which it was collected, or as may be required or permitted under the applicable laws.
    2. 18.We will cease to retain, or will remove the means by which the data can be associated with you (e.g. by keeping the data only in an anonymized form), as soon as it is reasonable to assume that retention is no longer necessary for the purposes for which the personal data was collected, and it is no longer necessary for legal or business purposes.

    Transfer of Personal Data outside Singapore

    1. 19.We will generally not transfer your personal data out of Singapore. If such a transfer becomes necessary, we shall seek your specific consent for your Personal Data to be transferred in this manner, and will seek to ensure that your personal data will remain protected to a same standard as it would have in Singapore.
